Terms and Conditions
The Cat Café Manchester is a registered limited company in England and Wales trading as CAT CAFÉ MANCHESTER and whose registered office address is 77B Water Street, Chorley, PR7 1EX (registered company number 09894710) and referred to in these terms and conditions as CAT CAFÉ MANCHESTER, WE or US.
‘Booking’ means a booking made for a period of time within the Cat Café Manchester or other facility made available through Cat Café Manchester’s channels and includes tickets, gift vouchers, food and any additional product or service (including those provided by a third party) purchased from Cat Café Manchester;
‘Contract’ means the agreement between us and you to fulfil a booking or purchase a product;
‘Customer’ means any customer who makes or is making a booking with Cat Café Manchester or purchases a product from Cat Café Manchester and reference to ‘you’ and ‘your’ shall have the same meaning.;
‘No Show’ means a customer who does not arrive and gives no notice or indication of such intent;
‘Writing’ means letter, fax or email;
‘Café’ means a cat café run by Cat Café Manchester or an independent owner affiliated to Cat Café Manchester;
‘Cat Nanny’ means a member of Cat Café Manchester staff specifically employed to look after the welfare of the cats;
‘Kids and Cats Hour’ means a designated pre-booked event for children aged 4 to 9 accompanied by their parent or guardian;
‘Operational Hours’ are Monday to Sunday 9am to 7pm;
‘Group Booking’ refers to booking of more than 10 people.
These conditions and any matters referred to by us, form the entire understanding between you and us and supersede any prior promises, representations (unless fraudulent) or undertakings.
Any omission or error in any sales literature, web page or site, order form, quotation, price list, order acknowledgement, dispatch note, invoice or other document issued by us may be corrected by us without liability. We will advise you of any changes at the time of making a booking or purchasing a product or as soon as is reasonably possible thereafter.
The provisions of the Contracts (Rights of Third Parties) Act 1999 are expressly excluded from the contract so that no third party may claim any rights under any contract.
Making a Booking
2.1 All bookings are subject to acceptance by us and we will confirm such acceptance to you by sending you an email that confirms that the booking has been successful. The contract between us will only be formed when we send you this confirmation. If you have made multiple bookings, the contract will only relate to the booking or part-booking that has been confirmed as successful. All bookings are subject to availability and the Cat Café Manchester reserves the right to decline any booking at its discretion. Upon receipt of this confirmation it is the responsibility of the customer to check all details confirmed are correct in terms of the customers’ requirements. If the customer considers there is an error, this must be brought to the attention of Cat Café Manchester within 14 days of receipt of the confirmation otherwise the contract will be considered to stand as per the terms outlined in this confirmation.
2.2 Bookings can only be discussed and amended by the customer who has made the booking and whose details are held on record by Cat Café Manchester.
2.3 Bookings to visit Cat Café Manchester may be confirmed by emailing us at firstname.lastname@example.org or by telephoning the café directly.
2.4 By making a booking or purchasing a product you warrant that you are legally capable of entering into a binding contract and that the information you have provided to us is correct. All booking and purchases made by telephone, web or other forms of distant communication are made subject to these terms and conditions and the person placing the booking warrant that he/she has the full authority to do so on behalf of all the persons they are making a booking for, and confirms that all such person are aware of and accepts these conditions.
2.5 To ensure Cat Café Manchester is a safe and suitable environment for our cats, children under the age of 10 are not permitted in the café. The only exception to this is during our ‘Kids and Cats’ hour bookable on the website in which children aged 4 to 9 are permitted into the café for supervised interaction with the cats under the supervision of a cat nanny or any other member of staff. Children aged 4 to 9 must be supervised by a parent or guardian at all times and will not be allowed into the ‘Kids and Cats’ event without such a person present. Similarly children aged 10 to 13 must be accompanied by a parent or guardian over the age of 18 at all times. Children below the age of four are not permitted into the café at any time or under any circumstance.
Valid ID Required
We work hard to maintain a safe and welcoming atmosphere for all of our guests. To assist with this you may be asked to present ID on arrival at Cat Café Manchester. We reserve the right to request ID from any guest upon arrival. We reserve the right to refuse admission at our discretion.
All customers may need to provide proof of identity that matches the name and/or address on the booking. Any of the following is accepted by Cat Café Manchester as an appropriate form of ID –
Services ID – Fire, Police or Forces
Valid photographic driver’s license, not more than 10 years old.
Student Identity Card, from a UK University with a current admissions date
A Bank Card when accompanied by another card that has the individuals name embossed on it, or accompanied by a letter or email with a matching name and address to the booking.
Payment shall be made in such format as we agree with you when you place a booking.
For any individual booking made in advance via the website or over the telephone, full payment is required at the point of booking.
For any group booking made more than three months in advance a provisional booking can be held for a maximum of up to seven days without payment. To confirm the booking a first deposit of 10% of the total booking value is required. Your first payment will confirm acceptance of the terms and conditions outlined in this document. The full balance of any group booking is due 8 weeks before arrival.
Sole use of the café by group bookings may be offered but will be subject to explicit agreement at the time of booking. Unless specifically highlighted in the confirmation, such guests will not be entitled to, nor should they expect sole-use of any café. In the case of booking a café on a sole-usage basis, customers may be asked to pay for a minimum number of tickets or be charged an additional supplement. These conditions will be agreed and confirmed at the time of the initial booking; sole-usage will not be guaranteed should the number of guests reduce below the agreed minimum at a later date.
If any payment under these terms and conditions is overdue, then without prejudice to our other rights and remedies we may cancel your booking and/or we may suspend the supply and/or deliveries of any other service being provided to you by Cat Café Manchester.
Deposits payable under clause 4.3 are non-refundable except in the circumstances laid out in clauses 6 and 12.
Changing a Booking
Changes requested from the date your booking is confirmed with payment will be treated as cancellations (see clause 6 below).
Changes to numbers of people or length of stay shall be treated as cancellation and shall be subject to our standard cancellation policy (see clause 6).
Changes to numbers of people in group bookings can decrease by 10% up to eight weeks before the booking without incurring a cancellation fee.
Cancellation and Refund Policy
All booking cancellations are subject to our refund policy contained within this clause.
All bookings can be cancelled, changed or fully refunded up to 48 hours before your designated arrival time. Please call or email the café directly to arrange this.
Bookings within 48 hours of arrival time are strictly non-refundable. This includes individual and group bookings made both over the telephone and online and is applicable to any no show or arrival outside of the agreed date and time outlined in your booking confirmation.
Promotional offers will be subject to specific terms and conditions and where they may conflict with these terms and conditions the terms and conditions of the promotional offer shall apply throughout the offer period. Any additional products or services included in these offers cannot be cancelled. No amendments or refunds can be made and offers are non-transferable. All offers are subject to availability.
Cat Café Manchester merchandise and any other product can only be delivered to UK addresses. Products and merchandise purchased can be returned to us in their original condition and packaging within 30 days of the date you received the item for a full refund. Postage for supplied products will not be returned unless the item is faulty or damaged.
Donations to Cat Café Manchester or an affiliated charity are non-refundable unless an error is made by Cat Café Manchester whilst processing.
Gift vouchers are non-refundable. Any voucher is redeemable only within the café in exchange for standard ticket and entry and/or merchandise and no cash alternative will be offered on whole, part, or remaining balances of vouchers.
Your Responsibility and Behaviour
Whether a group booking or a booking made by or on behalf of individuals, if the behaviour of yourself or any member of your party is considered likely to cause danger, damage or offence to other customers or our cats, we reserve the right at our reasonable discretion to cancel or terminate your visit immediately. If any member of Cat Café Manchester staff considers that the behaviour of any member of your party is unacceptable, they are authorised to end the stay and you will be asked to leave the Cat Café Manchester premises. Should this situation arise your booking will cease and we will not be obligated to cover any expense that may be incurred by the party concerned, neither will we consider any claim for compensation or refunds. Should any such behaviour halt or interrupt Cat Café Manchester’s ability to continue trade you will be responsible for compensating Cat Café Manchester in full for losses directly or indirectly incurred. Furthermore such behaviour or damage may lead to civil or criminal proceedings where appropriate.
We pride ourselves on creating a friendly, welcoming and safe environment for our customers and cats. And breaches of our admission, behaviours or cat protection and safety policies will be treated seriously and regarded as a breach of these terms and conditions.
By entering Cat Café Manchester all customers hereby agree to the following rules regarding the welfare of our animals –
You cannot wake cats if they are asleep
You cannot pick cats up.
You cannot chase cats.
You cannot take photographs of cats using flash photography.
You cannot feed the cats any food except food specifically authorised by the café.
You must remove any heavy or heeled footwear and wear the slippers provided. If shoes are admissible shoe covers must be worn at all times.
You must sanitise your hands before entering the café.
By entering the café you consent to the condition that by nature cats can be unpredictable. Any interaction with cats you engage with whilst on the premises, whether as an individual or group, is entirely at your own risk. Cat Café Manchester will not be held responsible for any personal injury or harm caused directly or indirectly to any customer from the cats.
Alcohol is not permitted on the Cat Café Manchester premises at any time. You are not allowed to bring your own alcohol in, even if it is not intended for consumption on the premises. If any customer is deemed to be drunk we reserve the right to refuse entry or terminate such booking immediately.
Smoking is strictly prohibited in any area of the café and this includes the use of any simulated smoking device such as electronic cigarettes or vapours.
In the unlikely event it becomes necessary to change your booking, in total or in part, Cat Café Manchester will inform you as soon as is reasonably possible of any necessary changes. You will have the choice of accepting the changed arrangements; or purchasing another booking from Cat Café Manchester subject to availability (and paying or receiving a refund is respect of any differences), or cancelling your booking and receiving a full refund for all payments made.
Delay or Failure to Perform
We will not be liable to you if we are prevented or delayed in the performing of any of our obligations to you if this is due to any cause beyond our reasonable control including (without limitation): an act of God, terrorism, explosion, flood, fire or accident; war or civil disturbance; strike, industrial action or stoppages of work; any form of government intervention; a third party act or omission; failure by you to give us a correct delivery address or notify us of any change of address.
Our liability to you
10.1 Cat Café Manchester will ensure that the Café and /or other products you order from us are provided in accordance with these terms and conditions and shall be provided by us with reasonable skill and care.
10.2 Where an element of your Booking is not provided to the standard stated in clause 10.1 you must notify us within 28 days of the alleged breach. We shall then investigate the matter and where necessary agree an appropriate level of compensation; depending on the nature and severity of the breach; compensation may take the form of partial / full refund, credit note towards a future booking, complementary service or other agreed benefit.
10.3 We will not be liable to you by way of representation (unless fraudulent), common law duty or under any express or implied term of the contract for: any losses which are not foreseeable by both you and us when the Contract is formed arising in connection with the supply of the services or their use by you; any losses which are not caused by any breach by us; or any business or trade losses.
10.4 Except in relation to death or personal injury caused by our negligence Cat Café Manchester’s liability remains, at all times, limited to the value of the Products purchased or the Booking made, excluding any amendment charges paid to us.
When using our website you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. By using this website you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in Writing. This condition does not affect your statutory rights.
The contract is subject to English law and the exclusive jurisdiction of the English Courts.
If any of these terms and conditions or any provisions of a Contract with you are determined to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be removed from the remaining terms, conditions or provisions which will continue to be valid to the fullest extent permitted by law.
We have the right to revise and amend these terms and conditions from time to time. You will be subject to the terms and conditions in force at the time that you make a Booking or purchase Products from us, unless any change is required to be made by law or if we notify you of the change to these terms and conditions before we confirm that your Booking or purchase has been successful.
We will only store and use the information you supply to us for the purposes of carrying out our Contract with you and to collect valuable feedback about how satisfied you were with the services provided. Cat Café Manchester understands that customers care about the use and storage of their personal information and data and we value your trust in allowing us to do this in a careful and sensible manner. By using Cat Café Manchester’s website, you are consenting and agreeing to practices outlined in this statement. Cat Café Manchester will always handle information in compliance with the Data Protection Act (1998).
